These Terms of Service, together with any written quotation, invoice, purchase order accepted by us, sales confirmation, service order, repair authorization, return authorization, and any other written terms provided by CN Hydraulic Parts, LLC, govern your access to and use of cnhydparts.com and your purchase or use of any products, parts, components, units, repair services, remanufacturing services, service exchange units, technical support, quote services, or other services offered by CN Hydraulic Parts.
Please read these Terms carefully. By accessing or using our website, requesting a quote, placing an order, purchasing products, sending us a component for repair, authorizing service work, or otherwise doing business with CN Hydraulic Parts, you agree to these Terms.
If you do not agree to these Terms, do not use the website, request a quote, place an order, or use our products or services.

Any standards, specifications, installation guidance, troubleshooting guidance, repair information, or technical discussion provided on our website or by our staff is for general guidance only and should not replace the applicable OEM manuals, manufacturer specifications, qualified mechanical judgment, or professional installation and service procedures.
5. Quotes and Orders
Most sales and service transactions begin with a quote. A quote is not a binding obligation unless and until accepted by CN Hydraulic Parts in writing.
All orders are subject to availability, final confirmation, and acceptance by CN Hydraulic Parts. We may accept, reject, cancel, or limit any order or quote request for any lawful reason, including product availability, pricing errors, supplier issues, credit concerns, export restrictions, suspected fraud, or incorrect product information.
Any purchase order, email, form, or other document submitted by you that contains terms different from or additional to these Terms is rejected unless expressly agreed to in a written document signed by an authorized representative of CN Hydraulic Parts.
If there is a conflict between these Terms and a written quote, invoice, sales confirmation, repair authorization, service order, return authorization, or other written agreement signed or issued by CN Hydraulic Parts, the more specific written document will control for that transaction.
6. Pricing
Prices are quoted in U.S. dollars unless otherwise stated. Prices are subject to change without notice.
Unless expressly stated in writing, pricing does not include taxes, duties, tariffs, shipping, freight, insurance, special packaging, installation, removal, reinstallation, testing beyond standard scope, customs fees, storage, expedited handling, or other related charges.
We reserve the right to correct pricing, availability, or description errors at any time, including after a quote or order has been submitted. If a pricing or product information error affects your order, we may cancel the order, request your approval for corrected terms, or provide another commercially reasonable solution.
7. Payment Terms
Payment terms will be stated in the applicable quote, invoice, or written sales confirmation.
Unless we agree otherwise in writing, payment is due before shipment or release of products, parts, components, repaired units, remanufactured units, or exchange units.
If credit terms are approved in writing, you agree to pay all invoices when due without offset, deduction, holdback, or counterclaim. Past-due amounts may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law. You are responsible for all reasonable collection costs, attorneys’ fees, and expenses incurred by CN Hydraulic Parts in collecting overdue amounts.
We may suspend fulfillment, shipment, repair work, service work, exchange release, or future orders if payment is late, credit is withdrawn, or we reasonably believe payment may not be made when due.
8. Taxes, Duties, Tariffs, and Fees
You are responsible for all applicable sales, use, excise, import, export, customs, duties, tariffs, and similar taxes or charges related to your order, except taxes based solely on our income.
If you claim a tax exemption, you must provide a valid exemption certificate or other documentation acceptable to us before the transaction is completed. If a taxing authority later determines that tax was due, you are responsible for the tax, penalties, interest, and related costs.
9. Shipping, Delivery, Title, and Risk of Loss
Shipping terms will be stated in the applicable quote, invoice, or sales confirmation.
Unless otherwise agreed in writing, all shipping dates are estimates only. We are not responsible for delays caused by suppliers, carriers, customs, weather, labor issues, shortages, incorrect customer information, force majeure events, or other circumstances outside our reasonable control.
Title and risk of loss pass to you upon delivery of the products to the carrier, unless otherwise agreed in writing. You are responsible for filing claims directly with the carrier for loss, delay, or damage in transit unless we expressly agree otherwise in writing.
Partial shipments are allowed. We may choose the carrier, shipping method, and packaging unless otherwise agreed in writing.
10. Inspection and Acceptance
You must inspect all products, parts, components, repaired units, remanufactured units, and exchange units promptly upon receipt.
Unless a different period is stated in writing, you must notify us in writing of any shortage, incorrect item, visible damage, or nonconformity within 10 days after delivery. If you do not provide written notice within that period, the products or services will be deemed accepted, and any inspection-based claim will be waived to the fullest extent permitted by law.
Any claim must include the invoice number, order number, part number if applicable, photos where relevant, a clear description of the issue, and any supporting documentation we reasonably request.
11. Returns
No returns will be accepted without our prior written authorization.
To request a return, contact CN Hydraulic Parts at sales@cnhydparts.com or (888) 384-2054. If approved, we may issue return instructions or a return authorization.
Unless otherwise agreed in writing:
- Return requests must be made within 10 days after delivery;
- Approved returns may be subject to a minimum 15% restocking fee;
- You are responsible for return shipping, freight, insurance, and proper packaging;
- Products must be returned in the condition required by CN Hydraulic Parts;
- Refunds or credits are subject to inspection, testing, and confirmation by CN Hydraulic Parts;
- Custom, special-order, electrical, opened, installed, used, damaged, altered, contaminated, or non-stock items may not be returnable;
- Shipping, freight, special handling, and service fees are non-refundable unless otherwise agreed in writing.
Inspection and testing may take time depending on the product, component, or issue. We reserve the right to deny a return, reduce a refund, or return the product to you at your expense if the item is damaged, used, incomplete, altered, contaminated, improperly packaged, or otherwise not eligible for return.
12. Service Exchange Units
Service exchange units may be offered when available. Exchange units are subject to availability, inspection, core requirements, pricing, deposits, and any additional written terms provided by CN Hydraulic Parts.
If a core return is required, you must return the core within the time and condition requirements stated by CN Hydraulic Parts. We may charge additional amounts, retain deposits, reject the core, or adjust credit if the core is late, incomplete, damaged beyond acceptable condition, contaminated, disassembled, altered, or otherwise unsuitable.
13. Repair and Return Services
If you send a pump, motor, component, unit, or other part to CN Hydraulic Parts for inspection, testing, repair, or remanufacturing, you authorize us to inspect and evaluate the item.
Any repair estimate or quote is based on the information available at the time and may change if additional issues are discovered. We will use commercially reasonable efforts to notify you of material changes before proceeding with additional work.
Unless otherwise agreed in writing:
- You are responsible for properly draining, cleaning, packaging, labeling, and shipping components to us;
- You are responsible for freight, insurance, customs, and related costs;
- We are not responsible for damage caused by poor packaging, contamination, prior misuse, improper disassembly, hidden defects, or conditions existing before receipt;
- Repair timelines are estimates only;
- Repaired or remanufactured items may include new, used, rebuilt, remanufactured, or replacement components as appropriate;
- Testing is performed according to our procedures and available equipment, unless a specific written test protocol is agreed to in advance;
- You are responsible for proper installation, flushing, commissioning, fluid cleanliness, startup, operation, and maintenance after return.
If you decline a repair after inspection, you may still be responsible for inspection, testing, teardown, cleaning, storage, shipping, and administrative charges.
14. Installation, OEM Specifications, and Customer Responsibility
Hydraulic products and components must be installed, commissioned, used, maintained, and serviced correctly. You are responsible for ensuring that all products, repaired units, exchange units, and components are installed and used by qualified personnel and in accordance with all applicable OEM manuals, manufacturer specifications, service procedures, safety standards, and laws.
CN Hydraulic Parts is not responsible for damage, failure, injury, downtime, equipment damage, contamination, poor performance, or other loss caused by:
- Incorrect installation;
- Improper startup or commissioning;
- Failure to flush or clean the hydraulic system;
- Contaminated fluid or improper fluid;
- Improper pressure, flow, temperature, alignment, configuration, adjustment, or operating conditions;
- Failure to follow OEM specifications or manuals;
- Unauthorized modification, disassembly, tampering, or repair;
- Misuse, abuse, accident, neglect, or ordinary wear and tear;
- Use in an application for which the product or component was not intended;
- Failure of related systems, hoses, filters, valves, electronics, controls, engines, or other equipment not supplied by CN Hydraulic Parts.
15. Manufacturer Names, Equipment Brands, and Reference Use
Our website and communications may reference manufacturer names, equipment brands, machine models, part numbers, symbols, descriptions, and trademarks, including Kawasaki, Caterpillar, John Deere, Case, Hitachi, Hyundai, JCB, Kobelco, Volvo, Link-Belt, and others.
These references are used for identification, compatibility, description, and informational purposes only. Unless expressly stated, they do not imply sponsorship, endorsement, affiliation, or that a part is manufactured by the referenced equipment manufacturer.
All third-party trademarks are the property of their respective owners.
16. Warranties
Warranty terms, if any, will be stated in the applicable written quote, invoice, sales confirmation, repair authorization, service order, manufacturer warranty, or written warranty documentation provided by CN Hydraulic Parts.
Unless expressly stated in writing by CN Hydraulic Parts:
- New products may be covered only by the applicable manufacturer or supplier warranty, if any;
- Used, rebuilt, remanufactured, repaired, service exchange, special-order, and customer-supplied components may have limited or no warranty;
- Warranty coverage does not include labor, removal, reinstallation, downtime, lost profits, lost production, freight, travel, equipment rental, substitute equipment, consequential losses, contamination, misuse, improper installation, or system-related failures;
- Warranty coverage is void or unavailable if the product or component is opened, disassembled, altered, tampered with, misused, contaminated, improperly installed, improperly maintained, used outside specifications, damaged after delivery, or repaired by anyone not authorized by CN Hydraulic Parts.
To the fullest extent permitted by law, except for any express written warranty provided by CN Hydraulic Parts, all products, parts, components, units, repaired items, remanufactured items, exchange units, services, website content, and information are provided “as is” and “as available.”
CN Hydraulic Parts disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and any warranties arising from course of dealing, course of performance, usage of trade, or oral statements.
17. Warranty Claims
To make a warranty claim, you must contact us in writing within the applicable warranty period and provide all information we reasonably request, including invoice number, order number, product identification, machine information, operating hours if applicable, installation details, photos, test results, failure description, and maintenance history.
No warranty claim will be accepted without our review and written authorization. We may require inspection, testing, return of the product or component, fluid samples, system information, or other documentation.
If we determine that a valid warranty claim exists, your sole and exclusive remedy will be, at our option:
- Repair of the product or component;
- Replacement of the product or component;
- Credit for the purchase price paid for the product or service at issue; or
- Another remedy we approve in writing.
We are not responsible for unauthorized repairs, third-party inspection fees, labor, removal, reinstallation, travel, rental equipment, downtime, lost income, lost production, consequential damages, or any cost incurred without our prior written approval.
18. Technical Advice and Troubleshooting
From time to time, CN Hydraulic Parts may provide troubleshooting support, product guidance, repair recommendations, installation suggestions, compatibility guidance, or other technical information.
Technical advice is provided for general informational purposes only and is based on the information available to us at the time. You remain responsible for confirming the accuracy, suitability, safety, and completeness of any information before relying on it.
No oral or written statement by CN Hydraulic Parts, its employees, representatives, vendors, or service providers will create a warranty or expand our obligations unless included in a written agreement signed by an authorized representative of CN Hydraulic Parts.

- Your information, instructions, specifications, or materials provided to us;
- Any claim by your customer, end user, employee, contractor, insurer, carrier, or other third party related to products or services supplied by CN Hydraulic Parts.
28. Limitation of Liability
To the fullest extent permitted by law, CN Hydraulic Parts will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost production, loss of use, downtime, equipment rental, substitute equipment, loss of business, loss of goodwill, data loss, property damage, third-party claims, or delay damages, whether based in contract, warranty, tort, negligence, strict liability, product liability, or any other legal theory, even if we were advised of the possibility of such damages.
To the fullest extent permitted by law, CN Hydraulic Parts’ total liability for any claim arising out of or relating to the website, products, parts, components, repairs, services, exchange units, quotes, orders, or these Terms will not exceed the amount you paid to CN Hydraulic Parts for the specific product or service giving rise to the claim.

Any statements about product performance, compatibility, delivery, availability, repair results, service life, or expected outcome are estimates only unless expressly stated as a binding commitment in writing by CN Hydraulic Parts.
30. Claim Limitation Period
To the fullest extent permitted by law, any claim or cause of action arising out of or related to the website, products, parts, components, services, repairs, exchange units, orders, or these Terms must be filed within one year after the claim arose, or it will be permanently barred.

Subject to any arbitration agreement or other written dispute-resolution agreement that may apply, any legal action arising out of or relating to these Terms, the website, products, services, quotes, orders, repairs, exchange units, or transactions with CN Hydraulic Parts must be brought exclusively in the state or federal courts located in Idaho, and, where venue is proper, in or nearest to Kootenai County, Idaho.
You consent to the personal jurisdiction and venue of those courts and waive any objection based on inconvenient forum or improper venue to the fullest extent permitted by law.

These Terms, together with any applicable quote, invoice, sales confirmation, repair authorization, service order, return authorization, written warranty, Privacy Policy, and any other written terms issued or signed by CN Hydraulic Parts, constitute the entire agreement between you and CN Hydraulic Parts regarding the website, products, and services.
They supersede all prior and contemporaneous oral or written understandings relating to the same subject matter.
